Article 1: General provisions
The electronic shop of www.hoppecruyt.be offers its customers the possibility to buy hops online.
These General Terms and Conditions ("Conditions") apply to all items from the range and to any purchase made by the customer from www.hoppecruyt.be.
The customer accepts that these Terms and Conditions, as the only one applicable, shall apply to the exclusion of his own general or specific (purchase) terms and conditions, even if they stipulate that they shall apply solely.
Article 2: Price
All prices are always VAT included. Transport costs will be charged separately and will be mentioned separately. The indication of price refers exclusively to the articles as described verbatim.
Article 3: Offer
Each offer is open for normal private use, but also for customers with commercial purposes, who then enter their VAT number. Some plants are sold for normal private use and have no plant passport.
Despite the fact that the website is created with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. When you have specific questions regarding for example varieties, availability, delivery time or delivery methods, please contact our customer service department in advance (see article 12).
't Hoppecruyt is only bound by an obligation of means with regard to the correctness, up-to-dateness or completeness of the information provided. 't Hoppecruyt is under no circumstances liable in the event of material errors, typesetting or printing errors.
The offer remains valid while stocks last and can be adjusted or withdrawn by 't Hoppecruyt at any time.
't Hoppecruyt is entitled - without indicating any reasons - to refuse orders, to adjust the delivery times, to split the deliveries, or to attach other conditions to the delivery.
Article 4: Online purchases
The customer can buy the articles from the www.hoppecruyt.be catalogue online.
The purchase is concluded when the customer receives a confirmation email from www.hoppecruyt.be. The articles will be delivered to the customer's home at the address indicated in the confirmation email.
The customer can choose between the following payment methods: VISA/Bancontact/Mister Cash/iDeal
If the payment is not received within a period of 2 working days, we are forced to cancel the order.
Article 5: Reservation of title
The delivered articles remain the exclusive property of 't Hoppecruyt until the moment of full payment by the customer. The risk of loss or damage shall, however, pass to the customer upon delivery. If necessary, the customer undertakes to inform third parties of the reservation of title of 't Hoppecruyt, for example to any person who would seize the not yet fully paid articles.
Article 6: Penalties for non-payment
Without prejudice to the exercise of other rights available to 't Hoppecruyt, 't Hoppecruyt reserves the right to cancel the purchase in the event of non-payment or late payment. The customer will be informed by e-mail. Without prejudice to the foregoing, 't Hoppecruyt reserves the right to withdraw items that have not been paid for (in full).
Article 7: Complaints
Any visible damage and/or qualitative deficiency of an article or other shortcoming at delivery must be reported immediately, under penalty of forfeiture of any right. You can reach our customer service 24/7 via info@hoppecruyt.be
Article 8: Warranty
- Legal guarantee (only for consumers)
Under the Act of 21 September 2004 on the protection of consumers in case of sale of consumer goods, the consumer has legal rights.
Each article is subject to the legal warranty from the date of purchase by (if applicable delivery to) the first owner. Any commercial guarantee does not affect these rights. - General
To make an appeal to the guarantee, the customer must be able to present the proof of purchase.
For items that were purchased online and delivered to the customer's home, the customer must contact the customer service department (info@hoppecruyt.be) beforehand, after which it will be decided in consultation how the item should be returned to 't Hoppecruyt.
Any defect must be reported within 1 month of its discovery. Afterwards, any right to replacement lapses.
The (commercial and/or legal) warranty never applies to defects arising as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article in violation of the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or modifications to the article, crackdown, poor maintenance, abnormal or incorrect use.
It also does not apply to items with a shorter life span, or wear articles.
Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable delivery, shall be deemed to be no hidden defects, unless the Customer proves otherwise.
The warranty is not transferable.
Article 9: Withdrawal term
The provisions of this article apply only to customers who purchase articles online in their capacity as consumer:
The consumer has the right to inform 't Hoppecruyt that he renounces the purchase, without payment of a fine and without giving a reason within 14 days from the day following the delivery of the product. Customers who wish to make use of the right of withdrawal must contact the customer service and return the goods at their expense to 't Hoppecruyt, Provenplein 69, 8972 Proven, Belgium within 14 days of delivery.
After receipt, the amount of the purchase will be returned without fine. The cost of returning the goods shall be borne by the customer.
Only items that are in their original and undamaged condition can be taken back (hops vacuumed in original packaging).
Will not be repossessed under any circumstances:
- If the products are subject to deterioration
Royal Decree of 6 September 1993 stipulates that the cooling-off period does not apply to products that can deteriorate quickly or products that by their nature cannot be returned (such as fresh hops, bulk hops and hop shoots).
Article 10: Privacy
't Hoppecruyt undertakes to use your data exclusively for the execution of the concluded agreement that you conclude by means of your order. This data will under no circumstances be used for commercial purposes or resold to third parties. If you would also like to receive information by e-mail, please provide your e-mail address.
We treat your information as confidential information and will never pass it on, rent it or sell it to third parties. You can request, correct, change or delete the data we keep in the customer list of www.hoppecruyt.be at any time and you can refuse that www.hoppecruyt.be uses your data to send you information. It is sufficient to write to the address below: Provenplein 69, 8972 Proven.
't Hoppecruyt strictly respects the Belgian act of 8 December 1992 on the protection of privacy in relation to the processing of personal data. Through your user profile you have access to all the available data about you at www.hoppecruyt.be for consultation, modification or deletion.

Article 11: Impairment of validity – non-renunciation
If any provision of these Conditions is declared invalid, illegal or void, then this shall in no way affect the validity, legality and applicability of the other provisions.
Failure of 't Hoppecruyt, at any time, to enforce any of the rights set out in these Terms and Conditions, or to exercise any of these rights, shall never be regarded as a waiver of such provision and shall never affect the validity of these rights.

Article 13: Amendment of conditions
These conditions are supplemented by other conditions explicitly referred to, and the general sales conditions of www.hoppecruyt.be In case of conflict, these conditions take precedence.
't Hoppecruyt may change these Terms and Conditions at any time without further notice. Any purchase after the modification implies acceptance by the customer of these new Terms and Conditions.
Article 14: Proof
The customer accepts that electronic communications and backups may serve as evidence.
Article 15: Applicable law - Competent court
The Belgian law is applicable, with the exception of the provisions of international private law concerning applicable law and the Rome-I Regulation on the International Sale of Goods relating to movable property. In the event of any disputes, the courts of Ypres shall have exclusive jurisdiction.
